1. Who we are, and acceptance

EFFIMEL is a lighting brand and online retailer selling direct to customers in the United States. We do not operate any manufacturing facility: we buy the pieces we sell from independent manufacturers, built to specifications we provide, and resell them. The site effimel.com and all orders placed through it are operated by EFFIMEL ("EFFIMEL", "we", "us"). Our registration and tax details are held on file with our payment providers and are given to customers, regulators or payment providers on request at Support@effimel.com.

These terms govern your use of the site and every purchase made through it, alongside our Return and Refund Policy, Shipping Policy and Privacy Policy, which are incorporated by reference. By browsing or ordering you confirm you accept them, and you must be at least 18 and legally able to enter a contract to order.

You may check out as a guest or create an account. You are responsible for the accuracy of the details you give us, for keeping your password confidential, and for activity under your account.

2. Products and specifications

Product pages state materials, dimensions, weight, electrical specification and environment suitability. Our fixtures are wired for 110–120V and are UL or ETL listed where applicable. Because our pieces are finished by hand, small variations in finish, glass and grain are inherent to the material and are not defects, and screens cannot reproduce a metal finish exactly. We may improve a design or discontinue a product at any time; where a change would materially affect an order already placed, we contact you before shipping.

3. Prices and pricing errors

Prices are in U.S. dollars and include free shipping within the United States and the import duties and tariffs we pay before a piece leaves. Sales tax, where it applies, is shown at checkout. Prices may change at any time, but never for an order we have already accepted.

4. Orders and order acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not accept it. The contract forms only when we send a shipping confirmation for the items in question. Until then we may decline or cancel an order in whole or in part — if a piece is unavailable, if the price or description was wrong, if we cannot verify payment details, or if we suspect fraud or unauthorized resale. Where we cancel, we refund in full.

Custom and made-to-order pieces are governed by the written quote we issue, confirming drawing, dimensions, finish, electrical specification, price and lead time. Approving that quote authorizes production, after which the piece is non-returnable.

5. Payment, duties and taxes

Payment is taken through Shopify's checkout using the methods shown there. You confirm you are authorized to use the method provided; we do not store full card numbers. If a payment is declined, reversed or charged back, we may suspend or cancel the order and any related production.

For deliveries within the United States, import duties and tariffs are calculated and paid by us before the piece ships, and nothing is collected from you on delivery. Sales tax is added at checkout where we are required to collect it. International orders are quoted individually, and any duties, taxes and customs charges are stated in that quote.

6. Delivery, returns and warranty

Delivery times shown on the site are good-faith estimates, not guarantees. Title and risk of loss pass to you on delivery. If a piece arrives damaged, photograph the packaging and the fixture and contact us within 14 days of delivery, as set out in our Shipping Policy.

Returns are governed by our Return and Refund Policy: 30 days from delivery on unused pieces in their original packaging, with custom and installed pieces excluded. Every piece carries a lifetime warranty to the original purchaser against defects in materials and workmanship, on the terms set out on our Lifetime Warranty page. Neither limits your rights under applicable consumer law.

7. Installation and electrical safety

Our fixtures are hardwired and must be installed by a licensed electrician in accordance with the National Electrical Code and any local requirements. Fixtures over 50 lbs cannot hang from a standard outlet box alone and require bracing above the ceiling; each piece's weight is listed in its specifications. We are not responsible for damage, injury or loss arising from installation by anyone other than a licensed electrician, or that does not follow the supplied instructions.

8. Intellectual property and your content

All content on this site — designs, drawings, photography, illustrations, text, logos and the EFFIMEL name — belongs to us or our licensors and is protected by copyright, trademark and design rights. You may view and print pages for your own non-commercial use, but may not copy, republish, scrape, resell or commercially exploit our content or designs, or use our marks, without written permission.

If you send us reviews, photographs or drawings, you confirm you have the right to do so and grant us a non-exclusive, royalty-free, worldwide license to use that material in our business, including on this site and in marketing. We may edit or remove submitted content. Submissions are not confidential, except drawings shared under a trade or project inquiry.

9. Prohibited uses

• Any unlawful purpose, or any use that violates a regulation or law.
• Scraping, harvesting, data mining, or running bots against the site.
• Probing or bypassing site or payment security; uploading malicious code, spam or phishing content.
• Reproducing our designs, photography or copy for a competing product or listing.
• Ordering for resale or export without our written agreement.

10. Disclaimer, liability and indemnity

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free, or that every dimension, weight or availability shown is complete and current. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. This does not limit the express Lifetime Warranty on the products themselves.

To the fullest extent permitted by law, EFFIMEL and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, for loss of profit, revenue or data, or for the cost of installation, removal, reinstallation or substitute goods. Our total aggregate liability arising from an order is limited to the amount you paid for it. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

You agree to indemnify EFFIMEL and its officers, employees and agents against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, your infringement of a third party's rights, or installation carried out other than by a licensed electrician.

11. Governing law and disputes

Before starting any formal proceedings, please contact us at Support@effimel.com — most issues are settled quickly once we can see the order. Nothing in these terms takes away any right you have under the consumer protection law that applies where you live.

12. Changes and general

We may update these terms from time to time; the version published here when you place an order is the one that applies to it, and the date below shows when this version was issued. If any provision is unenforceable the rest stay in force, our failure to enforce a right is not a waiver, and you may not assign your rights without our consent. These terms, the policies referenced in them and any written custom quote are the entire agreement between us.
